馄饨 » 言论 http://5chaos.com 馄饨，又不是混乱 Thu, 15 Jul 2010 07:23:27 +0000 en hourly 1 http://wordpress.org/?v=3.0 关于抄袭的胡言乱语 http://5chaos.com/index.php/2007/12/about_copy.htm http://5chaos.com/index.php/2007/12/about_copy.htm#comments Wed, 05 Dec 2007 14:31:03 +0000 馄饨 http://silenteer.com/2007/12/about_copy.html 抄袭，是中文领域一个很奇特的现象，不但是抄，而且还理直气壮的抄。网络上如此，随便找一篇有价值的文章一搜，便是数十条同样的信息。你甚至都不能从其中区分出谁是作者，谁是抄袭者。这就像冯导的《大腕》中那个要做“乐哈哈”纯净水广告的假货商人所说，“广告做多了，假的也就成真的了”。另一方面，《梦里花落知多少》被判抄袭《圈里圈外》，而郭敬明却依旧嚣张。论文直接的抄袭更是家常便饭一般，我甚至看到正规出版的学术文章就是国外厂家设备说明书的中文翻译！
网络，只是让抄袭变得更加方便而已。
抄袭的方式不同，从关系上分为3种。第一种，个人抄袭个人。这种情况多如牛毛，稍微有一点儿本事建个网站，又没有能力提供丰富的内容，显然要通过其他手段来扩充自己的门面。不过，一般抄得人往往没有被抄的人名气大，多而且无序，基本上也没有什么办法。第二种，是门户抄袭门户，这就会引发大规模的口水战，而且吵到最后也不会有什么实质性的结果。大家都是出来混的，炒作够了，毕竟还要跟人家留口饭吃。第三种，就是大门户抄袭个人。这个就比较没有水准了。但多数情况下，个人小网站也没有什么办法。你可以大声疾呼，但人家干脆不理你。当然，想罗永浩之流的悍匪还是可以通过法院敲出一笔钱来的，不过，一般人就没有这个本事了，别说是敲出钱来，可能连链接都没有。可这也没办法，我们不是悍匪，自然活得也不够彪悍。
忍了，所以就是现在的局面了。

PS：想起Boston Legal中Shirley在法庭上引用德国牧师Martin Niemoller在波士顿犹太人大屠杀纪念碑上的一段话：“在德国，他们先开始对付共产党人，我没有说话，因为我不是共产党人；后来他们对付犹太人，我也没有说话，因为我不是犹太人；后来他们对付工运者，我也没有说话，因为我不是工运者；后来他们对付天主教徒，我还是没有说话，因为我是新教徒；最后他们对付我，这时已经没有人剩下来可以为我说话……”

Boston Legal第二季第五集里面，有一段我非常喜欢的台词。女律师Denise Bauer着手于一宗拖延了三年的案子——由于卡车的自燃引发了火灾，夺取了原告妻子的生命。卡车厂商同意赔偿，但无法在数额（$225,000）上达成一致。焦点在于原告的妻子罹患癌症，只能活大概六、七天了，而他们又试图证明原告的妻子是吸入过来浓烟而安静地去世的，没有任何痛苦。
被告方的律师整年面对的就是这类案件，因而也练就了一段惯用的精彩开场陈词，用以避免陪审团受原告的情感所影响。但通过录像，Denise Bauer制定了针对性的开场陈词，完全打乱了对方的计划。
对于原告妻子只剩余不到7天的生命，Denise Bauer诠释了人世间唯一剩余几天时光的珍贵，而丧失了这最后的时光所造成的巨大伤害（Well, you will hear from Jose Pitino, and what you will hear is that she had a day and another day coming after that and another one after that. She had, in fact, six or seven days to be at home with her family. She didn’t get those days. She never got that last opportunity to sit with her grandchildren. Jose was never able to hold his wife of 37 years in his arms. Hold her in his arms and, um… if any of you have spent the final days with a loved one dying of cancer or another disease, you know that those moments are the most precious. Jose and Elena Pitino had those days coming. They didn’t get them. ）。
另外，Denise Bauer特别注意去运用Shirley Schmidt提示给她的“感同身受”，将这一个灾难联系到每一个陪审员的身上（So you see, this is potentially your problem. How do you motivate a corporate conglomerate to fix a defect? You make it too expensive for them not to. At the conclusion of this trial, when it finally comes down to a dollar amount, I’ll be asking you to be legislators and come back with a number that says to the defendant and all car manufacturers, “Make your vehicles safe”. For your sake, for your daughters, for your grandsons. And I’ll ask you to be human beings, the conscience of a compassionate society, and return with a verdict that somehow reflects everything that was taken from Elena Pitino, her family and most of all… her high-school sweetheart.）。
最后，居然达成了$ 1.7 Million Dollars。
Denise Bauer在陪审团面前多次提到一个观念——为了让我们有安全的卡车，为了让厂商不敢不去大量投入成本去提高卡车的安全性，我们要让大厂商们懂得如果他们不这样做，就要付出巨大的代价（too expensive）！而在我们国内，大多数涉及人命案件的赔偿都并不高，甚至有同命不同价的问题（城乡差异）！而另一方面，很多生产事故、公共安全事故却越来越严重，关键就是“人命太便宜了”！
PS: 貌似Lori就是在这一集中那个性骚扰投诉后离开的，唉！
